General terms of trading

Welcome to the Robust d. o. o. web-store, hereinafter splitter.si/store The website is operated by the Robust d.o.o. company, provider of e-commerce services. (hereinafter »company«). These general terms listed hereinafter apply to all consumers, and need to be abided by. General terms are composed in accordance with valid Slovenian legislation. In case you do not agree with the general terms stated here, we implore you to leave the website. We withhold the right to change the general terms on the website cepilnik.si/trgovina at any time with a preliminary notice on the website. All the changes of the general terms are obligatory for consumers.

The consumer is anyone that can freely register at the web store.

The prices and terms of payment

All the published prices are in EUR and include VAT. The prices apply for purchasing via the website cepilnik.si/trgovina, and can be changed without any prearranged notice. All the prices apply at the moment we deliver the order. The subjects to VAT are obligated to specify their tax number at the registration.

The payment of the chosen goods is possible in two ways:

– payment upon delivery;  the buyer chooses the method of payment »upon delivery« when giving out the order. At the moment of accepting the order, we will confirm it and reply you with the status »processing«. If the product is in stock, we send it off within 3 working days (status »sent«), in the opposite case the buyer is informed by e-mail or telephone.

Delivery by the post of Slovenia or DPD: When receiving the shipment the buyer pays the material, the shipment expense, as well as the expense of the transfers, to the post employee or to the post office, in case you were not present when the delivery was brought to your address . – payment by estimate (Universal payment order UPN): the buyer chooses the method »by estimate«, with which the user will receive a notice about the details of the estimate to his post address, including all the payment data, with which the total amount of the purchase is transferred via bank or online bank to the transaction account SI56 3000 00001 1115 751, Sberbank banka d.d.. Only legal or physical persons can choose to pay with the estimate. For a quicker procedure and sending of the ordered products, we ask you to send us proof of payment. Guarantee

All products have a guarantee, as stated on the guarantee list or on the account. The guarantee is valid by following the instructions on the warranty, and upon presenting the invoice. The due dates of the guarantee are listed on the warranty, or on the invoice. The information on the guarantee is also listed on the page with the product presentation. If the information about the guarantee is not listed, it means the information cannot be provided at the moment. In that case you can contact us at: 031/819 788 and receive the updated information. The consumer can enforce guarantee for products with a compulsory guarantee and for which a voluntary guarantee was given. In the guarantee expiry date the consumer can demand a free abolition of the fault. If the mistakes aren’t possible to abolish, or the company doesn’t abolish them in the shared deadline of 45 days, the consumer can demand a replacement for a new free product.

Guarantee does not cover:
– Any kind of construction changes or upgrading that the manufacturer does not approve
– Manipulation with failure to meet the terms that are demanded in the technical guide
– The unskilled usage of the splitter and it’s equipment because of the disregard of
the instructions for usage
– The disregard of basic instructions for safe work with the splitter and its equipment
– The bad or irregular maintenance of the splitter and the insufficient surveying of the key vital parts
– If the splitter and it’s gear is used by an uninformed person, a minor, or a person with lesser psychophysical capabilities
– normal wear of the product
– mechanical injuries (such as: injuries caused with sharp objects, compression, falling etc.)
– mistakes or damage caused with the improper usage of the product, that is with handling contrary to the instructions for usage of the manufacturer
– mistakes because of factors that are out of the reasonable reach of the guarantee –does not cover the mistakes that arose because of the usage of the product for other purposes than for the one anticipated or from the side of a third person
– The guarantee does not cover mistakes that arose because of integration of the product with the wrongly installed or defective accessories

Material defect

The consumer (user) can invoke the faults on the purchased goods from the address of the guarantee, or from the address of the material defect, in accordance with the conditions of the Law on consumer protection (ZVPot)

The consumer can invoke reclamation for every bought product (which means, that the consumer can invoke the rights from the material defect, because of the defect on the product, for which there was no guarantee. The same can also be determined also in case he does not wish to invoke the guarantee for the product, for which a guarantee was given).
According to the Law on consumer protection the defect is real:
– if the merchandise doesn’t have properties, that are needed for specific use, for which the buyer buys it, but that was known to the salesman or should have been known;
– If the merchandise doesn’t have the properties or merits that were explicitly or tacitly prescribed;

– if the salesman delivered the merchandise, that does not fit the pattern or model, except if the pattern or model was shown solely because of the notification.

From the address of the material defect the consumer can advertise the defect on the product with the salesman, namely in two months from discovering the material defect (for defects, that are not shown on the product after two years from the takeover, the salesman is no longer responsible), and by his own choice demand an abolition of the mistake or the refund of the paid amount, in proportion with the defect, the exchange of merchandise, or the refund of the paid amount. The consumer must specifically describe the mistake in the notice, and allow the salesman to examine the product. If the defect is not at issue, the company must as soon as possible, but no later than in 8 days, comply to the consumers demand. If there is an argument about the defect, the company must give the consumer a written response in the same deadline. Limitation of liability

The company Robust d.o.o. is trying its hardest to ensure accuracy, keeping up to date, and the accuracy of data, published on this website. The company is reserving its right to change the content of the website without previous notice. Even though the company tries to assure detailed photographs of the products,all photos should be understood as symbolic. The photographs do not ensure the properties of the article.

User registration procedure

The pages of the web store cepilnik.si/trgovina are available to registered users, as well as to anonymous visitors of the web store. When completing the complimentary registration, each user re-creates his password. Every user ensures that his user name and password will be disposed only to himself or to his representative.

Order and pre-order

The orders can be made 24 hour per day, all days in a year. The order processing starts immediately after receiving the order after checkout. After the complete order the consumer will receive a message with all the information of the order per e-mail. The costumer must make sure to insert the correct data. As soon as the products are shipped, the costumer receives an e-mail notification. The service provider does not hold any responsibility for the delivery delays, caused by the delivery company or suppliers. When the costumer places the order, we assume he accepts and agrees with all general terms. The cepilnik.si/trgovina web store does not carry any additional responsibility, if the product is not ready to be sent, or in case of the delay in shipment.

The right to contract termination, return of products and payments

According to article 43/č of the Law on consumer protection the costumer (meaning only for private persons, purchasing the products outside their economic activity) has a right to withdraw from the contract, without having to state his reason, within fourteen (14) days from receiving the product, by writing an e-mail to info@robust.si The only expense the costumer must pay in case of withdrawal from the contract is the expense of return-shipment. We do not accept packages with ransom! The merchandise must be returned to the salesman within 14 days of contract (purchase) withdrawal notification. The form for withdrawal from the product contract is available to the costumers at WITHDRAWAL FORM link. The products must not be used or damaged, and must be in their original packaging, which should not be damaged, or the return will be denied. In case the costumer orders two or more products simultaneously, he has a right to contract withdrawal for single products. The tenderer returns the complete purchase price in the time period 14 days after receiving the undamaged goods, in which the purchase price will be returned per transaction to the costumer’s bank account. The buyer must return the merchandise to the following address: Robust d.o.o., Arja vas 104, 3301 Petrovče. If the tenderer delays the return of the purchase price, he must also pay interests and one tenth of the received payments for each thirty days of payment delay.

Product return for legal persons

If you wish to receive a company invoice, you accept the operating conditions, valid for companies (same as the conditions for physical persons, but without the possibility of withdrawal within 14 days). We enable companies, freelancers and other legal entities to return the product shipments in accordance with the warranty conditions. Legal entities don’t have the right of contract withdrawal in 14 days or the purchase price return, as the consumers (physical entities) have.

The return of damaged shipments

in case the costumer receives a physically damaged shipment, a package with signs of being opened, or the package is missing certain content, the delivery must be reported to the delivery company, stating the conditions of the received package (without adding or taking anything from it) and begin the process of complaint at the delivery company, filling in the complaint form. Together with the delivery company we will aim for the complaint to be solved in the shortest time possible.

Dispatch, shipment and receiving of products

The products will be delivered to the costumer with a delivery company, in the shortest possible time of 3 – 5 working days. In case we are not able to deliver the product within that time, we will inform you about it immediately through the e-mail address or phone number you provided. The products that are in stock will be shipped within 3 days. We don’t ship any deliveries on Saturdays, Sundays or during holidays. If the product is not in stock or cannot be shipped for another reason, we will notify you about it as soon as possible.

Product delivery via post of Slovenia/DPD:

In case you will not be available at the time of the delivery, you will receive the receipt of the delivery. In that case you can pick up the ordered product at your local post office, within 15 days. If you do not receive the products within 30 days after the placed order, we will send you an e-mail in which you can cancel or prolong the order until the product is back in stock. Free shipment applies to all deliveries higher then 500 EUR.

Contract preservation

All signed contracts between the salesman and the buyer are preserved at the headquarters of Robust d.o.o., Arja vas 104, 3301 Petrovče. All invoices will be permanently stored by the salesman. The buyer can receive his own copy of the contract by sending a request to info@robust.si.

Copyright protection

The content of the cepilnik.si/trgovina website is property of Robust d.o.o.. All copying, use, publishing, distribution of the web content or parts of it without the permission of Robust d.o.o. is forbidden.

Complaints and disputes

Any costumer complaints can be sent to info@robust.si.The company is by all means trying to complete its duty of creating an effective system for treating complaints. The company is by all means trying to resolve any disputes unanimously. In case this is not possible, the disputes will be solved by the local court in Žalec.

Out-of-court solution to costumer disputes

In accordance with the legal norms ROBUST d.o.o. does not acknowledge any out-of-court solution executor as an official executor for the solution of a costumers dispute, that the costumer can initiate according to Regulation on consumer online dispute resolution,.
